“Legislation in the Age of Artificial Intelligence: A New Paradigm for Balancing Promotion and Regulation”

Although Artificial Intelligence (AI) is having a profound impact on politics, the economy, society, and public administration, the legal framework needed to address the wide range of policy issues arising from AI has not been adequately established. This legislative delay—a situation in which the enactment or amendment of necessary laws is delayed for various reasons despite being needed—is not always negative in itself. However, it has left various AI-related problems unresolved, such as the lack of training data for AI, insufficient support for private-sector technological innovation ecosystems, personal data breaches enabled by AI, and digital crimes. To this end, this issue brief examines the underlying causes (legislative challenges) of such legislative delay and offers recommendations for the future direction of AI legislation.
