“Comparing Korea–U.S. Regulatory Systems for Emerging Industries and Policy Recommendations for Innovation-Led Growth”
This issue brief compares the regulatory systems for emerging industries in Korea and the United States and offers policy recommendations for fostering innovative growth in Korea’s new industries. The United States primarily operates a post-regulation system, which allows market entry for new industries first and then manages any adverse effects that arise. This approach has facilitated market creation and strengthened U.S. global leadership in emerging sectors.
By contrast, Korea employs a pre-regulation system based on the principle of “prohibition in principle—permission by exception,” which has been criticised for slowing the growth of emerging industry markets. Accordingly, the brief diagnoses the limitations of Korea’s regulatory framework and proposes policy directions such as introducing post-regulation mechanisms and restructuring industrial competition to support innovation-driven growth.
